Traffic Tip Tuesdays: Passing on the Right

In an effort to promote awareness of state traffic laws, the St. Mary’s County Sheriff’s Office posts excerpts of the 2018-2019 edition of The Maryland Vehicle Law Annotated on Tuesdays.

Adhering to the law will make roadways in St. Mary’s County and in Maryland safer for drivers, passengers, bicyclists, horse-and-buggy operators and pedestrians.

Passing on the right:

Passing on the shoulder while another vehicle is making a left turn became legal in Maryland in 2017.

Sec. 21-304 “The driver of a vehicle may overtake and pass to the right of another vehicle only:

-If the overtaken vehicle is making or about to make a left turn

-On a highway with unobstructed pavement not occupied by parked vehicles and wide enough for two or more lines of vehicles moving lawfully in the same direction as the overtaking vehicle

-On any one-way roadway, if the roadway is free from obstruction and wide enough for two more lines of moving vehicles.”

Further, “the driver of a vehicle may overtake and pass another vehicle to the right only if it is safe to do so.”

A driver may not leave the roadway to pass on the right.


Sheriff's Office Sergeant Trains Canine Teams in the Middle East

Sgt. Todd Fleenor and canine teams in the United Arab Emirates


Sgt. Todd Fleenor, K-9 Unit Supervisor of the St. Mary’s County Sheriff’s Office, recently trained and certified several canine teams in the United Arab Emirates.

Sgt. Fleenor is a Master Canine Trainer for the International Police Work Dog Association. That organization requested that Sgt. Fleenor travel to the UAE to certify 15 canine teams in the area of narcotics detection for the country’s Federal Customs Authority. It is a new program for the country and its officials requested an evaluation and certification of the initiative.

For three days, Sgt. Fleenor conducted narcotics certifications in the areas of building searches, vehicle searches and open-area searches. He also toured the canine center and was given a detailed presentation of the plans and expectations of their program.

After completing certifications and evaluations, Sgt. Fleenor presented information from the International Police Work Dog Association, the narcotics certification and suggestions on how to improve the UAE’s program.

“I am very proud of Sgt. Fleenor and our entire Sheriff’s Office K-9 team,” Sheriff Tim Cameron said. “The men and women of our unit demonstrate excellence on both the national and international stage and I am very pleased that we can share our expertise across the globe.”

Identity Sought for Theft Suspect

The St. Mary’s County Sheriff’s Office is seeking the identity of the person pictured. On Friday, Feb. 1, 2019 at 4:20 p.m., the suspect was exiting the Giant Food Store in California with merchandise, which he tried to hide under his camouflage jacket. When he was confronted by a Giant employee, the suspect began to run and while fleeing dropped the merchandise.

On View Arrests:

Drug Arrest-  On January 29, 2019, Dep. Fenwick conducted a traffic stop in the 27700 block of Three Notch Road in Mechanicsville.  The operator of the vehicle was identified to as Joseph Patrick Collins IV, age 19 of Mechanicsville.  Dep. Fenwick smelled the strong odor of marijuana emitting from the vehicle as well as observed a container of suspected marijuana in the vehicle.  Search of the vehicle yielded four pills, suspected Alprazolam, and suspected marijuana greater than 10 grams.  Collins was arrested and charged with Possession of Marijuana Greater than 10 grams, and two counts of Possession of CDS-Not Marijuana.  CASE# 6009-19

Assault-  On January 30, 2019, DFC. Muschette responded to the 21700 block of North Essex Drive in Lexington Park, for the reported assault.  Contact was made with the victim who advised Misty Ann Morgan, age 27 of Lexington Park, struck the victim in the face, and also dragged the victim by the victim's hair down a set of stairs.  Injury was observed to the victim, and Morgan was arrested and charged with Assault 2nd Degree.

Stolen Vehicle-  On January 31, 2019, Dep. Chase responded to the 20800 block of Flour Mill Court in Lexington Park, for the report of an individual in the area attempting to break into vehicles. A witness advised an individual, later identified as Travis Dimitri Smoot, age 31 with no fixed address, drove a truck into the area, and parked the vehicle partially in the roadway and partially in a yard. Smoot was then observed walking the neighborhood and attempting to enter multiple vehicles. Dep. Chase canvassed the area and located Smoot, and the truck he was operating.  A check of the truck indicated it had been reported stolen. Smoot was also found to have gift cards, loose change, and other items that had possibly been stolen from vehicles on his person. Smoot was arrested and charged with Motor Vehicle/Unlawful Taking and Rogue and Vagabond.  CASE# 5571-19

Assault-  On February 1, 2019, Dep. Hersh responded to the 41600 block of Shadrick Street in Leonardtown, for the reported assault.  Investigation determined Daniel Bernard Underwood, age 61 of Leonardtown, repeatedly struck the victim in the head with his fist.  Visible injury was observed to the victim and Underwood was arrested.  Underwood began yelling and making threats while outside on the way to Dep. Hersh's vehicle, and continued to be disruptive throughout the investigation.  Underwood was charged with Assault 2nd Degree and Disorderly Conduct. CASE# 6588-19

Mechanicsville Crash Under Investigation

On Feb. 7, 2019 at 8:09 p.m., St. Mary’s County Sheriff’s Office Deputies responded to a motor vehicle collision involving a single vehicle into a tree. Units arrived on the scene to find a Ford Focus had left the roadway and struck a tree, trapping the driver. Fire and EMS personnel removed the driver from the vehicle and the St. Mary’s County Collision Reconstruction Unit members were called to the scene.

Preliminary investigation revealed that a 2009 Ford Focus, operated by Kyle Andrew Capps, 20 of Mechanicsville, was traveling southbound on Thompsons Corner Road. The vehicle had just negotiated a sharp curve in the area of Bethel Church Road when the operator lost control of the vehicle. The car crossed the centerline and ran off the northbound edge of the road where it struck a tree, trapping the driver inside.

The driver was transported from the scene to MedStar St. Mary’s Hospital in Leonardtown and then transferred to Washington Hospital Center for further treatment.

Motor Vehicle Collision-Lexington Park

On February 7, 2019, deputies from the St. Mary’s County Sheriff’s Office responded to the 19200 block of Three Notch Road in Lexington Park, for the reported motor vehicle collision involving three vehicles. The Sheriff’s Office Collision Reconstruction Unit responded to the scene and continued the investigation. 

Preliminary investigation determined a 2008 Honda Civic operated by Alexa Taylor Smith, age 23 of Owings, was traveling southbound on Three Notch Road in the area of King James Parkway.  Smith attempted to make a U-turn at King James Parkway, and was struck by a 2013 Ford Escape traveling southbound, operated by John Wesley Lonkert, age 39 of Scotland, Maryland. After being struck, Smith’s vehicle entered the northbound lane where it was struck by a 2017 Hyundai Santa Fe operated by Joseph Dennis Spalding, age 58 of Hollywood, Maryland. Smith and a passenger were transported to an area trauma center, and a juvenile in Smith’s vehicle was transported to Children’s Hospital for treatment.  Lonkert was transported to MedStar St. Mary’s Hospital with incapacitating injuries.

Shooting Investigation in Lexington Park

On February 3, 2019, deputies from the St. Mary’s County Sheriff’s Office responded to the 46800 block of Rogers Drive in Lexington Park for a reported shooting complaint.  Shell casings were located in the area, and a residence nearby had been struck with projectiles.  No injuries have been reported from this incident.

UPDATE-Motor Vehicle Collision-Lexington Park

UPDATE:  On February 9, 2019, the juvenile Emma Leigh Clarke, age 3 months, succumbed to the injuries sustained in the motor vehicle collision.  The investigation is ongoing. 

On February 7, 2019, deputies from the St. Mary’s County Sheriff’s Office responded to the 19200 block of Three Notch Road in Lexington Park, for the reported motor vehicle collision involving three vehicles. The Sheriff’s Office Collision Reconstruction Unit responded to the scene and continued the investigation.

Indecent Exposure-  On February 1, 2019, Dep. Shelko responded to the St. Mary's County Detention and Rehabilitation Center located in Leonardtown, for the reported indecent exposure.  The victim advised fellow inmate Devin Eric Webb, age 31 of Leonardtown, has been repeatedly and intentionally exposing himself to the victim.  Webb was charged with Indecent Exposure.  CASE# 6655-19

Assault-  On February 2, 2019, DFC. D. Smith made contact with the victim who advised of an assault which had occurred in the 30100 block of Huntt Road in Mechanicsville.  Investigation determined Thomas Justin Flora, age 41 of Mechanicsville, assaulted the victim by striking the victim in the face, causing a black eye and laceration to the victim's lip.  Flora was arrested and charged with Assault 2nd Degree.  CASE# 6764-19

Assault-  On February 2, 2019, Cpl. Corcoran responded to the 20600 block of David Way in Lexington Park, for the reported assault.  Investigation determined Francis Elizabeth Barnes, age 62 of Lexington Park, assaulted the victim by throwing a metal bucket at the victim, which struck the victim in the face causing injury.  Barnes also threw hot wax onto the victim's couch, damaging the furniture. A second victim intervened to keep Barnes from committing further assaults, however Barnes assaulted the second victim, causing injury to the victim's arm.  Barnes was arrested and charged with two counts of Assault 2nd Degree and two counts of Property Destruction.  CASE# 6838-19

CDS Arrest-  On February 3, 2019, Dep. Budd responded to the Three Notch Trail, located behind  the 45000 block of Miramar Way in California, in reference to a check the welfare request.  Upon arriving in the area, Shenandoah Dornell Benton, age 42 with no fixed address, was located sitting on the trail with several cans of compressed air.  Dep. Budd then observed Benton place the tip of one of the cans into her mouth and inhale the substance.  Benton was arrested and charged with CDS-Inhale Substance.  CASE# 7031-19

DUIs:

2/2/19-  Dep. Fenwick responded to the 23000 block of Oakley Road in Avenue and located a vehicle in the middle of the roadway with no lights on, and the driver asleep behind the wheel.  The vehicle operator was identified as Terry Ann Nelson, age 54 of Chaptico.  It was determined Nelson had been operating the vehicle under the influence of alcohol. Nelson was arrested and charged with Driving Vehicle While Under the Influence of Alcohol and Driving Vehicle While Impaired by Alcohol.   CASE# 6734-19

2/2/19-  Dep. Westphal responded to the 18000 block of Point Lookout Road in Park Hall for the reported reckless operation.  Dep. Westphal located the vehicle and made contact with the operator Thurman Alexander Harmon Jr., age 68 of Saint Inigoes.  Harmon was found to be under the influence of alcohol.  Harmon was arrested and charged with Driving Vehicle While Under the Influence of Alcohol, Driving Vehicle While Under the Influence of Alcohol Per Se, and Driving Vehicle While Impaired by Alcohol, and Driving Motor Vehicle Within 12 hours of Previous DUI arrest.  This was Harmon's 2nd DUI arrest within 12 hours. Headlights on when wipers are on

Sec. 22-201.2 “If a driver of a vehicle on a highway operates the vehicle’s windshield wipers for a continuous period of time because of impaired visibility resulting from unfavorable atmospheric conditions, the driver shall light the vehicle’s headlamps.” In other words, if it’s raining or snowing, the vehicle’s headlights should be on while driving.

Enforcement is a secondary action and the fine is not to exceed $25.

Public's Assistance Sought in Property Destructions

The St. Mary’s County Sheriff’s Office is seeking the public’s assistance in the investigation of multiple instances of property destruction in the Country Lakes neighborhood in Mechanicsville.

On or about Feb. 7, 2019, several residential properties were vandalized with spray paint in the area of Tin Top School Road and Yowaiski Mill Road. The cases are under investigation and the Sheriff’s Office is asking neighbors for suspect information or any surveillance video they may have that could assist deputies.

Assault-  On February 3, 2019, Dep. Shelko made contact with the victim who reported an assault which occurred in the 41300 block of Riverview Road on Mechanicsville.  Investigation determined Wayne Carroll Earnest, age 40 of Mechanicsville, had assaulted the victim during an argument by grabbing the victim around the neck and strangling the victim.  The victim displayed visible injury as a result of the assault.  Earnest was arrested and charged with Assault 2nd Degree.  CASE# 7079-19

Violation of Protective Order-  On February 4, 2019, DFC. Holdsworth responded to the St. Mary's County Detention and Rehabilitation Center for a reported protective order violation.  Investigation determined Thomas Franklin Hill Jr., age 44 of Mechanicsville, requested messages be relayed to the victim through a third party.  This was in violation of a current court order prohibiting Hill from having contact with the victim by any means.  Hill was arrested and charged with two counts of Violate Protective Order.  CASE# 7300-19

Assault-  On February 5, 2019, Dep. Forinash responded to the 45900 block of Indian Way in Great Mills, for the reported disturbance.  While on scene, Latoya Renee Mason, age 36 of Great Mills, was hostile and aggressive, and assaulted the victim by pushing the victim in the presence of Dep. Drug Arrest-  On February 5, 2019, Tina Marie Tippett, age 31 of Lexington Park, was transported to the St. Mary's County Detention and Rehabilitation Center for outstanding warrants with another law enforcement agency.  When Tippett was searched, she attempted to discard suspected synthetic marijuana, which she had concealed on her person.  Also hidden on Tippett's person was a suspected synthetic marijuana cigarette.  Tippett was charged with Possession of Contraband in a Place of Confinement by Cpl. Assault-  On February 7, 2019, Dep. Raley responded to the 42300 block of Calvert Circle in Mechanicsville, for the reported assault.  Investigation determined Teresa Lynn Wilkes, age 41 of Mechanicsville, threw an item at the victim, striking the victim in the head which caused injury to the victim.  Wilkes was arrested and charged with Assault 2nd Degree.  CASE# 7855-19

Theft-  On February 8, 2018, Dep. Forinash responded to the 45100 block of First Colony Way in California, for the reported theft.  Investigation determined Wayne Darnell Somerville, age 31 with no fixed address, was in the Target store and damaged numerous items in the electronics department by breaking into the packages and removing the security devices.  Somerville then attempted to leave the store with the items concealed in his shopping cart.  Somerville was arrested and charged with Theft and Malicious Destruction of Property.  CASE# 8165-19

Assault-  On February 8, 2019, Dep. Shelko responded to the 29700 block of Allen Road in Mechanicsville for a reported disturbance.  Investigation determined Eric Douglas Fortner, age 39 of Mechanicsville assaulted the victim during an argument.  Fortner grabbed the victim around the neck, and also kicked holes in a door, broke the victim's glasses, and a kitchen table.  Fortner was arrested and charged with Assault 2nd Degree and Malicious Destruction of Property.  CASE# 8258-19

Drug Arrest-  On February 9, 2019, Dep. Forbes responded to the 21400 block of Manon Way in Lexington Park, for the reported suspicious vehicle.  Dep. Forbes located the vehicle and made contact with the operator Franklin Lee Russell, age 22 of Lexington Park.  Russell was observed moving something under the seat of his car; Dep. Forbes recognized the odor of marijuana emitting from Russell's vehicle.  A search of the vehicle yielded a backpack containing packages of suspected marijuana, two scales, and edible suspected THC.  Russell was arrested and charged with CDS-Possession: Marijuana Greater than 10 Grams, and CDS-Possession: Paraphernalia.  Additional charges pending a review with the States Attorney.  CASE# 8274-19

2/6/19-  DFC. Davis responded to the 16500 block of Piney Point Road in Piney Point regarding a disturbance inside a vehicle. DFC. Violation of Protective Order-  On February 9, 2019, Dep. Chase responded to the 23300 block of Holly Hill Lane in California, for the reported violation of a protective order.  Contact was made with the victim who provided Dep. Chase with text messages and voicemails from Audra Mignon Deitz, age 41 of California, that were sent to the victim.  There is an active court order preventing Deitz from contacting the victim.  Deitz was located and arrested and charged with Violate Protective Order.  On February 10, 2019, Dep. Forbes contacted the victim who reported another violation.  The victim advised once Deitz was released from the detention center, she again sent messages to the victim.  Dep. Assault/Violation of Protective Order- On February 11, 2019, Dep. Forbes responded to the 18200 block of Waterview Drive in St. Inigoes for the reported assault.  The victim advised during an argument David NMN Roche, age 40 of St. Inigoes, struck the victim in the face causing injury.  Dep. Suspect Sought in Store Robbery

On Feb. 16, 2019, deputies of the St. Mary’s County Sheriff’s Office responded to the Donut Connection at 21801 North Shangri La Drive in Lexington Park for a reported robbery. Preliminary investigation revealed a black male suspect threatened an employee with a weapon and forced entry to the business. Once inside of the business, the suspect stole an undisclosed amount of U.S. currency and fled the area.

The suspect is described as follows:

Black male with short black hair, scruffy facial hair in a beard and goatee, a black hooded jacket with fur lining on the edge of the hood, blue jeans, and gray sneakers.

Motor Vehicle Collision Under Investigation

On February 18, 2019, at approximately 4:46 a.m. deputies from the St. Mary’s County Sheriff’s Office responded to the report of a single vehicle collision in the 22800 block of Three Notch Road, in the area of Miramar Way, in California, Maryland.  Upon arrival officers located the vehicle, with the operator trapped inside. The operator, and sole occupant of the vehicle, was extricated and transported to an area hospital with incapacitating injuries. The St. Mary’s County Sheriff’s Office Collision Reconstruction Unit responded and continued the investigation.

Preliminary investigation determined a 2005 Chevrolet Tahoe operated by Gina Marie Polo, age 32 of Leonardtown, was traveling northbound on Three Notch Road when the vehicle left the roadway and struck a tree.  Polo was initially transported to MedStar St. Mary’s Hospital, and subsequently transported to Washington Hospital Center for further treatment.

Motor Vehicle Collision Update

UPDATE: Kyle Andrew Capps, age 20 of Mechanicsville, succumbed to his injuries on February 17, 2019. The parents of Kyle Andrew Capps, would like to share with the public that several of his organs were donated so that others may continue to live.

On Feb. 7, 2019 at 8:09 p.m., St. Mary’s County Sheriff’s Office Deputies responded to a motor vehicle collision involving a single vehicle into a tree. Units arrived on the scene to find a Ford Focus had left the roadway and struck a tree, trapping the driver. Fire and EMS personnel removed the driver from the vehicle and the St. Mary’s County Collision Reconstruction Unit members were called to the scene.

Preliminary investigation revealed that a 2009 Ford Focus, operated by Kyle Andrew Capps, 20 of Mechanicsville, was traveling southbound on Thompsons Corner Road. The vehicle had just negotiated a sharp curve in the area of Bethel Church Road when the operator lost control of the vehicle. The car crossed the center-line and ran off the northbound edge of the road where it struck a tree, trapping the driver inside.

The driver was transported from the scene to MedStar St. Mary’s Hospital in Leonardtown and then transferred to Washington Hospital Center for further treatment.

At this time, speed appears to be a contributing factor in the collision. Anyone who may have witnessed the collision or events leading up to the crash are asked to contact Cpl. Traffic Tip Tuesdays: Avoiding Traffic Signals

In an effort to promote awareness of state traffic laws, the St. Mary’s County Sheriff’s Office posts excerpts of the 2018-2019 edition of The Maryland Vehicle Law Annotated on Tuesdays.

Adhering to the law will make roadways in St. Mary’s County and in Maryland safer for drivers, passengers, bicyclists, horse-and-buggy operators and pedestrians.

Avoiding a Traffic-Control Device:

Sec. 21-201.(a)(2) Traffic Signs, Signals and Markings

“The driver of a vehicle approaching an intersection controlled by a traffic-control device may not drive across private property or leave the roadway for the purpose of avoiding the instructions of a traffic-control device.”

This illegal driving behavior is sometimes observed on northbound Three Notch Road (Route 235) during the evening commute.

The fine for avoiding a traffic-control device is $90 and one point assessed on a driver’s license or $130 and three points if contributing to an accident.

On Wednesday, Feb. 6, 2019 at 7 p.m. and again on Tuesday, Feb. 12, 2019 at 2:51 p.m., the suspect exited the Belk store in California with a large plastic bag of clothing that he did not pay for.
